When justice is essential. . .

     Following are examples of wrongful death cases and resulting jury verdicts:

  • The family and estate of a 41-year old security guard brought suit against a trucking company and its driver due to an accident which occurred on a highway in 2003.  The trucking company's driver had partially blocked the highway with a 72-foot long double tractor-trailor rig.  The jury returned a verdict for the family and the estate for over $3,000,000.00.

  • The parents of an 11-year old brought suit against the foreign manufacturer of a candy that was made with a gel that bound the candy together, but did not break down well in the moisture and warmth of the mouth.  The child had run to her father for help when the candy sealed her throat and prevented her from breathing.  The jury determined that the snack was unsafe for its intended purpose and presented an unacceptable risk of chocking.  A verdict was entered in favor of the estate and family of the child in the sum of $16,700,000.00.

 

  • The plaintiff's father, mother and brother were killed when their SUV swerved to avoid hitting another car and rolled.  The jury determined that the SUV was defective and unreasonably dangerous in that its design rendered it prone to toll over and the roof would fail when it did.  The jury returned an award of $5,000,000.00 in compensatory damages and a punitive damage award of more than $250,000.00.  (The trial judge vacated the punitive damage award and ordered a new trial on that issue.)

 

  • The widow and parents of a refinery worker was killed a fire at the plant.  The case settled for $9,000,000.00.
